To echo what others have said already, you *need* that password. We have an iDevice here that is stuck in the same situation and we've been through the phone tree at Apple. Short answer: you need the phone unlocked by the owner of the Apple ID and then turn off Find My iPhone. Apple did say that if we can find the original paper receipt, they would also unlock it if the serial number is recorded there. We don't have that.

Nope. What Speedy said. Its locked. No getting in w/o password.

Try too many passwords and its bricked for life. Sell for parts.
I thought too many incorrect password attempts only resulted in the onboard data being erased?

that's just the passcode to get past the lock screen on the phone. The iCloud lock is a different thing.
