Based on a few similar cases we've had around these parts lately--
The driver gets 9 months of night jail with the ability to leave in the daytime to go to work. They get to keep their license because they need their car to get to work.

Vehicular Manslaughter. The argument would be whether or not it was voluntary or involuntary. His priors should net him some time.

But it WOULD ensure that the same driver wouldn't do it TWICE!
