I think if the head of a federal agency has that discretion then I don't see a reason to get hung-up on a technical formalism that doesn't happen to also include state governors. Perhaps the judgement, criticisms and arguments about the rules are moot. In my humble opinion the argument for not using the flag is somewhat childish and demonstrates a good measure of rigidity.
