Schumer has been quoted as saying that if they push a nominee through, "nothing is off the table." ... and I don't think it's just in the hands of the Senate Dems, it's more like it's in the hands of the Senate Repubs, some of whom might, just maybe might, have a spine... Make a court eventually rule that there's an actual opening on the SC to be filled. If birth certificates are fair game ... It might get interesting if they subpoena RBG to testify.
