He was told he had to have a mental health clearance to return, so there was little doubt as to what was going on there. He was considered dangerous. That should create a flag of some sort to prevent him from buying a weapon, I would think. "Loughner, accused of killing six people, shooting Arizona Democratic Rep. I don't think he was ever convicted of anything that would make him fail a background check. As for getting kicked out of Pima, I don't think he ever tried to get back in, hence no mental health evaluation, so that wouldn't show up either. He tried getting into the Army and was turned down; I don't know why that didn't show up.
