Insurance Companies define themselves as Bastids ~!~ - haikuman - 10-23-2011 http://news.yahoo.com/miracle-tornado-survivor-denied-workers-comp-170556418.html 'Miracle' tornado survivor denied workers' comp JOPLIN, Mo. (AP) — By all accounts, Mark Lindquist is a hero, an underpaid social worker who nearly gave his life trying to save three developmentally disabled adults from the Joplin tornado. Both houses of the Missouri legislature honored Lindquist, the Senate resolution calling him "a true hero and inspiration to others." But heroism doesn't pay the bills. The tornado's 200 mph winds tossed Lindquist nearly a block, broke every rib, obliterated his shoulder, knocked out most of his teeth and put him in a coma for about two months. Lindquist, 51, ran up medical expenses that exceed $2.5 million, and the bills keep coming. He requires 11 daily prescriptions and will need more surgery. But he has no medical insurance. Lindquist couldn't afford it on a job paying barely above minimum wage. He assumed workers' compensation would cover his bills, but his claim was denied "based on the fact that there was no greater risk than the general public at the time you were involved in the Joplin tornado," according to a letter to Lindquist from Accident Fund Insurance Company of America, his company's workers' comp provider. Re: Insurance Companies define themselves as Bastids ~!~ - Black - 10-23-2011 There are few worker's comp cases in which the beneficiary is treated fairly without legal representation. It's a little baffling that he doesn't have a lawyer representing him (or that there's no mention of it if he does.) Re: Insurance Companies define themselves as Bastids ~!~ - cbelt3 - 10-24-2011 Oh, you can be SURE there will be many lawyers happily lining up to represent him. Odds are this 'finding' came out while he was still in a coma. When I had a serious injury at work, the lawyers were sending letters and calling for months. They STILL send letters. 10 years later. (My company took GOOD care of me. I think I paid a total of $4.50 for a bottle of Advil, but decided not to bother putting in for a refund.) Perhaps you missed the point of the story..>>> duh ~!~ He is being fssked by the insurance company....... What is less compelling is your Dakotaesque comments ... :priate: Re: Insurance Companies define themselves as Bastids ~!~ - Black - 10-24-2011 haikuman wrote: Nope, understood the story. If you can find the patience, try reading the whole thread rather than just the first and last post. Re: Insurance Companies define themselves as Bastids ~!~ - cbelt3 - 10-24-2011 What I'll point out is that, from what I've seen, a majority of stories of 'xxx has been screwed by yyyy big company' appear to have been planted by xxx 's attorney. As a result, they are written from a single perspective. I'm not arguing that denying this person's claim is 'right' from a human / ethical standard. It's not. But it's probably legal. I think both the purpose of the story, and of posting it here, was to highlight the gap between was is legal and what is right. And personally, i'm okay with that. |
