When it comes to public property it can be difficult to balance the interests of those who want to speak to other members of the public using their free speech rights with people's "right" to not be overly disturbed by other people when they are in public. Given only the information provided in the article, it appears to me that the police, as is probably their understandable natural inclination, came down too far on the side of "not disturb the public" in this case. The problem with profanity is that it's like pornography - whether something is considered profane or pornographic is highly dependent on the sensitivities of the individual - especially in the "lighter" forms of each. Is it a photograph of an artistically posed nude or a picture of a sexually posed licentious hussy meant to stimulate prurient interests? My inclination would be to say that all laws against profanity are stupid and should be declared unConstitutional - but then, it's not unusual for me to break into a bit of profanity and I grew up with my dad barely being able to speak several sentences without using profanity, so I'm obviously not very sensitive to it. But I think even most of those who are sensitive to profanity would admit that using the word "hell" in a Biblical context isn't profanity. The police were using that as a thin pretext to get him to move on.
