Or during his term can you do this in the government? I guess we will find out but I would think it would be inherent in a government contract and void from a private individual like 45.

The article said hard to enforce but is it legal?

If it's hard to enforce, it's essentially illegal, right?

His NDAs are deterrents first, and guarantees second.

It's weird to think, at this stage, that too many would want to come forward with much, when the environment is already such that someone like Mueller could simply compel them to testify regardless.

No way is this legal. It's nothing more than trying to keep his image under his control by ridiculous threats. At least the NDA stated that the money would go to the federal government and not him. But, federal employees work for the constitution and are certainly free to talk about Trump all they want. He is not going to stop the books and chats with reporters.

Except it won't. Between groups like the ACLU and Federal Unions this NDA will be struck down if anyone attempts to enforce it. It may be pursued before anyone tries to take action. The DOJ would have to prosecute and that just isn't going to happen. Even if Pruitt were put in charge. A prosecutor would look like an idiot.

But that might work both ways. It would mean that 45 would have to spend his money to fight a case where he wouldn't see a dime, but the money would go to the US Treasury.

Given his views on paying taxes to the US Treasury I think it may be a difficult decision for him.

The attorneys still get their fees. Just set up a Trump shell company under which the attorneys work.

I'm not a lawyer, but I suspect an NDA to cover up illegal activity can't be enforced. Still intimidating to potential whistleblowers, and waaaay over the top. But this whole administration is waaaay over the top.
