As soon as the Senators are sworn in, he plans to call a vote on the constitutionality of the impeachment trial, forcing Republicans to go on the record on the matter. If 17 GOPers don't vote in favor, it telegraphs that the trial will fail.

‘ Two historical precedents, both involving federal judges, make clear that the Senate could also vote to disqualify the president from holding office in the future, with only a simple majority needed.

Paul Campos, a professor of constitutional law at the University of Colorado, said that even if the Senate does not convict the president, senators could hold a second, separate vote to prevent him from future office.

That would mean Democrats, who will take control of the Senate later in January, could bar Trump from running for president in 2024 even without the support of Republican senators.

Trump could, however, try to challenge such a determination in court, Campos said. The Supreme Court in 1992 said it would not second-guess the Senate’s decisions about how to handle impeachment proceedings.

“The Senate has great latitude in deciding how it wants to conduct a trial,” Campos said.

Other legal experts, however, said the Senate could only prevent Trump from holding office if it first votes to convict him in the impeachment trial.

Lawmakers could also declare that Trump engaged in “insurrection or rebellion” under the 14th Amendment to prevent him from running again. This would require a majority in both the House of Representatives and the Senate. ‘

45 senators vote that the trial is unconstitutional...

HOLD THE TRIAL ANYWAY... evidence will be presented and some of it will be horrifying - especially to people that don't follow every news tweet all day long. It's far less complicated than the last impeachment.

Did Impeachment #1 teach anyone anything ? Republicans are above the law, and don't give two craps about it. Evidence ? Nobody will hear anything. Moscow Mitch will protect his party. Period. Laws are irrelevant. Constitutions are irrelevant. Voters are irrelevant. You will be assimilated.

Sedition all you want in the last two weeks. If you lose, let your term expire and retire to a life of luxury immune to prosecution. If you win, you get to write the new constitution making you president for life.

Yeah, I don’t think that the Senate (and especially just the Senate Republicans) get to ignore the constitution and say they are not going to conduct a trial.

Disappointing to see 45 Rs lineup lockstep to ignore their constitutional duties (and the constitution, not to mention democracy in this country). Nevertheless, I think they ought to hold a trial and present evidence over a couple of days, even if the spineless GOP will block conviction.

So Joe can resign in January 2025, and president Harris can have all of congress machine gunned, an become empress....and faces no penalty if that falls through. Do they not get precedent? Or that's just for the dems....
