UPS damage claim? - RecipeForDisaster - 02-02-2022

I treated myself to some fancy macarons, as I have done a few times before. The UPS package was plopped down on compacted snow in my driveway, not even near my door. I don’t have a camera, but they were in a bad spot. The macarons are packed well in a custom 3D plastic case, then a bubble wrap envelope, and they still shattered. A very first world problem, but they are not cheap, and they have always arrived perfect. The box was almost $50.

I started a claim and provided photos of the box (not damaged), packaging layers, and broken macarons. I won’t have them as evidence for too long because they will be eaten (and I sure am not going to turn them over to UPS… am I?). How does this usually go?

Yeah, they told me to submit a claim. That was possible, as the recipient, on UPS' website.

Sounds like the shipper didn't use sufficient protective packaging. A plastic case and a bubble wrap envelope doesn't cut it for something as fragile as macarons (macaroons?). Have the shipper send you replacements and the shipper can deal with UPS for the damages.

Being that the value of the goods is less than $100, It is possible UPS will just pay out the bucks once it receives the paperwork but more likely outcome is they'll deny the claim due to insufficient protective packaging. Either way, it'll be the shipper's problem, not yours.

If you decide to put in a claim, you'll need to submit the photos and an invoice for proof of value. End result is likely the same as above. Personally, for $50, I'd tell the shipper to send me a new box of grub and let them deal with UPS.

Plastic case inside a box inside a bubble envelope inside a box. They have always arrived perfect. Sorry if I wasn’t clear. I don’t think she’s interested in pursuing a claim or replacing for me, but I will work that angle if I don’t win with UPS. I did submit good photos.

but...you're eating them? So the loss is just the satisfaction of crunching a perfect macaron? Not sure I'd dicker over that.

They are very fancy and beautiful, and because they are shattered, the effect is lost. They are crispy on the outside and chewy on the inside, and now the outsides are just powder in the package. I realize it’s a first world problem… but they can’t be eaten normally and are often a gift.

So, I’m not sure what I do next, because I don’t have a UPS account number or claim number. Even in the email they sent.

The claim is listed under a green approved button and says:
Claim Issued - Inspection Not Required

What’s next? I did not show proof of purchase because it wasn’t requested in the claim, but there is something to upload it now. However, it requires a claim number and account number.

No worries. You were clear in your description. It doesn't change my assessment. It's still an issue of insufficient protective packaging. That they have arrived intact previously doesn't change anything. It looks like one of the two possibilities of what UPS would do came through. the low value of the items was enough for UPS to automatically resolve the claim in your favor.

You have a claim number. Now you need a UPS account number and therein lies a problem. You didn't ship it on your own account. This is why the shipper and not the receiver who puts in the claim. You have to contact UPS and the shipper to resolve this aspect of the claim process.

OK. I really felt that the packaging was very protective, especially with the double box and form fitting insert. It did say fragile on the outside, sigh. My UPS people don’t usually drop my packages here.

Their site lets me submit a claim as a recipient. I don’t have a claim number - not that I can find. We’ll see what the shipper says.

One of my hobbies is collecting chess sets. Tiny little delicate intricate carved pieces of wood. You can imagine the nightmare involved in making sure all 34 pieces arrive intact without any damage from across the country — and in some cases, across the globe. If there is damage, it is always the seller's headache. Not the buyer/recipient. Shove it back in their court to sort out.

I hear from multiple high-volume sellers of chess sets, USPS/UPS/FedEx NEVER pay. The seller will eat (sorry) the loss and move on.
