i think the blame actually lies with over-litigious society.
if people didn't sue for every damn injury, nobody would be afraid of the liability.

Not to rain on the libertarian parade, but wasn't there a story last year about a boy killed in a collapsing snow fort? I mean, do what you want, but sometimes we don't always think things through in the zeal of construction. I'd rather be served notice than find my kid under Frosty's detached head.
