Seems to me the earbud thing is personal responsibility again....You don't drive with hot coffee between your legs if you don't want to get burned. When did personal responsibility disappear in our lives...? The French thing is another kettle of fish. They went after MSFT now it is Apple's turn since it is popular.
Moral: be an ugly duckling and people will ignore you-no lawsuits.
