Oh, and file with the BBB.
Grar! Dell wants their migration kit back after I buy it for $9 and they charge me $31.

For those in a similar situation as mattkime, here's my thinking on this:
Basically, the premise ('leg') you'll be standing on is that you saw an item advertised at Dell for a specific price on December 13th (it would help if someone had a screen shot of this). You placed an order for this item and paid for it on December 13th (for which you have proof via the order confirmation email from Dell dated December 14th). Dell shipped you the item. You received the item December 18th. At this point your business transaction with Dell is over. After the fact, Dell comes back and charges your card (on December 26th) an additional amount, which you did not authorize. This is basically the argument you'll make to your credit card company.

Hmm.. I didn't notice this until now - but my credit card hasn't been charged anything yet (I received the 1GB micro cruzer and surge protector over a week ago). Thanks for the heads up - no doubt Dell will be coming after all of us who jumped on that deal. I've got the original webpage, "order details" page, and confirmation email all saved as pdfs, just in case.
mattkime - pm me your email address if you'd would like a copy of the original webpage offer (in pdf format).

Excellant SD! That'll make this an open and shut case for those affected.

grm...just spent some time talking in circles to someone in their customer service department. He'd occasionally babble about how "Dell cannot be responsible for pricing or other errors, and reserves the right to cancel orders arising from such errors." which just made me wonder if he actually understood english.
I suspect that this is a weird enough fuckup that I have to deal with someone from the US. Hopefully someone I can pin down with logic - the weakness with that strategy being that dell reps thus far aren't bound by logic. They think its okay to correct pricing errors after an item has shipped.

If the person you're speaking with can't comprehend the implications behind charging one's card without authorization, you should ask to speak with their supervisor.

Matt, try to call in the morning (around 10 or so) when most Indians are asleep. Many of them (Indians) are smart and understand what's going on. But unfortunaetly Dell management (i.e. Americans) confound them to read from a script and not deviate from it.
It's kind of funny, when I had my troubles, it was an Indian in their accounts department (outsourced) that contacted me. I knew it was an Indian because he had the same last name as me (which in itself is a rare name in India). (^_^)

FWIW, none of the eight people I spoke with thought it was a pricing error.

I ordered the Desktop Migration Bundle on December 13 and received it a few days later. My credit card was charged $9.74, which was the correct amount with Texas sales tax. At the same time the dialog appeared on this forum, I received an email from Dell saying that my LapLink PCMover Bundle had shipped. I looked at my previous emails from Dell for this order and was not sure what they were sending. I checked my credit card and saw that I had not been charged the $9.74 in mid December but had on December 29. The LapLink PCMover arrived today.
I called India and tried to explain the problem. The lady was nice but had to disappear a couple of times to discuss it with someone else. She finally told me that I would see only one $9.74 charge on my card and that I could keep the PCMover. She also said she would send an email documenting our conversation. I will continue to monitor my credit card account. |
