I believe you can either make your own patched OS X dvd (or USB stick), or you can download an already patched version.
As long as you own a copy of OS X for your hackintosh, it's no more illegal than putting OS X on a Dell mini.

You still have to use a hacked copy of Leopard, whether you own it & hack it yourself or d/l it. The Dell Mini 9 works with a standard retail copy of Leopard and you can update it all the way to 10.5.6 and possibly beyond.
Any time you update one of those kludged installations, you stand a very good chance of breaking something because you don't know what is inside the "black-box". I had an MSIWind that worked pretty well with 10.5.5 and when I updated to 10.5.6 the keyboard and trackpad didn't work. I returned it and got a Dell Mini 9.

Once you use a hacked version of the OS, you can run software updates on the system. It will break the OS and the computer won't boot. AFAIK, you can run OS updates on the Mini 9 without issue.
