Are these real Apple earbuds or not, Buyer is claiming Item Not As Described, Bandwidth warning!

Even though that iPod Touch was broken, it is still less than a year old, and under warranty, so the ear buds and dock cable should be covered under the warranty. The warranty is based on the serial number, not the buyer. Tell him to take it to the genius bar and tell them that are defective because they don't feel right, and ask Apple to replace them (with ones that will feel exactly the same).
