While it seems obvious that Rove's group is not a "social welfare" group spending less than 50% on politics, the IRS itself does not agree with what you are saying about the nature of the documents it sent ProPublica, per this report of May 13 in "The Hill."
ProPublica says it followed up with the IRS at the time to find out why it had been provided the confidential materials. The IRS responded by saying it would be illegal for ProPublica to publish the documents.
