The Constitution does not limit the number of justices and allows Congress to determine the number. They haven't changed it in 150 years, but they can.
If McConnell and Graham are able to get their terrible Trump nominee confirmed, and Dems control both chambers after January, then I think they should do this, and Biden could then appoint two liberal justices
After the shenanigans of Garland and now this with Ginsburg, it'd be only fair.
