If your receipt says it was an Open Box, I would be honest with them and tell them you found out why it was an open box.

If you have no proof that you weren't the first to open the package and the drive was so as "new", I wouldn't risk it. I'd just tell them it does not work. Maybe mention to them that you had been worried when you saw the box was damaged...
