Standard policy for Apple doing battery exchanges is you turn in the iPod, and they give you back one that has had its battery replaced. Yours then goes into their pool of units waiting to have their batteries changed out. They could replace it with the same model, or a similar one. The replacement can be new, used or refurbished, depends on what is available, though as I understand it, Apple will try to keep it to used or refurbished on battery exchanges at the $59 rate they charge. They are more likely to use new ones when an older model is sent in for the out of warranty repair service charge of $249 for issues other than battery replacement.
