Firing a gun isn't an appropriate reaction to misdemeanor trespassing.

But she 'had a right.' Isn't that enough justification? The man might've violated her "old farm equipment."

when you are her age, in rural kentucky, and someone is tresspassing, yeah, it kind of is.
if you really delve into the deadly force laws, it is almost a sliding scale depending on who is the deffendant and the circumstances. And it also varies state by state. I can't remember which state it is, but it has a shoot on sight is allowed statute for trespassers.

So he could be detained, identified, trespassed and otherwise investigated. Given the prior thefts, then he may even become a suspect in those. Depending on the state, it may even qualify for citizen arrest.

She shot out the tires, then said he was lucky in his behavior subsequent to that that she didn't kill him. HuLoooooHooooo!

No, it's not. But at the time she fired at the tires, she apparently believed they were possibly burglars, not mere trespassers. As he/they were not caught with any property, "simple trespass" or misdemeanor trespassing was the crime charged. She shot out the tires, he/they couldn't escape, and were captured and charged. I really like this part: She had to balance on her walker as she pulled out a snub-nosed .38-caliber handgun. Nice shootin', Venus! An 82 year old woman, alone in rural Kentucky, shoots tires so possible thieves, definite trespassers are arrested (three were released)... I have *no* problem with that.

>>she apparently believed they were possibly burglars,
what ever happened to backing up belief with facts? ...must...resist...urge...to...make...political...reference...

So you're cool with people being armed and with an itchy trigger finger, even though you'd prefer they'd not be driving? Have gun, will travel (anywhere my walker can take me).
