He says pay me then I'll payoff the loan and the bank will send you the title. In the mean time he says I can take the truck. Something is not right. What is the right way of doing this?

The RIGHT way of doing it is to go down to his bank TOGETHER, see the loan officer, and you pay off the loan and get the title RIGHT THEN.
Otherwise, it's a scam, trick, or in some other way dirty.

I kinda think he doesn't know either. What if the bank isn't local or some finance company?

It is precisely the hassle that gives me pause. Otherwise it is a good deal. On the other hand, people must be doing this all the time.

find out who the LEGAL owner is. THAT is the bank or the financer. Then decide. Who you are talking to is the REGISTERED owner. Totally different from a legal standpoint.

I would stay away from it unless you get things in order. Ask him where the title is. If you can't call them up and verify it, forget about it.
