Are these real Apple earbuds or not, Buyer is claiming Item Not As Described, Bandwidth warning!

These are the earbuds that came with the broken glass iPod Touch 4th Gen 8Gb that my niece had for
two when she broke it. She never used the earbuds and I put in the description that it came with the
original Apple dock cable and earbuds he is claiming the earbuds are fake and that the reason he paid $141 for
the the broken iPod is because it included a headset that should be worth $32.60, his exact quote. Take
a look and see what you think. I told he'll send back the earbuds in the exact condition as pictured and I
have them looked at and they are indeed fakes I'll send him my brand set from from my iPhone 4, I'll
never use them because Apples earbuds will not stay in my ear no matter what. One day I'll learn to do
like 90% of the sellers on eBay and describe things as vaguely as possible. I took multiple pictures at
different settings until I got a photo that satisfied me. These are crops of the bigger photo, the last two
are pretty bad. I also told him if this would not be satisfactory with him we could just take it up with
eBay, my wife has never lost a dispute with a buyer and she's seen some whoppers.

I've got an iPod Touch 4G purchased from Amazon, and the earbuds are unopened, and I just compared them to your picture, and they look identical. Any idea what to look for to determine real vs. fake?

I don't know. Unless he thinks they are suppose to have the Microphone on them and even Cnet said one of the
Cons was and I quote: "No in-line microphone on the earbuds". I think he's just trying get $32.60 out of us.

I'd bet that he was somehow expecting to get the ones that Apple sells separately which includes the microphone. Which also explains his $32.60 price ($29 + tax?).

Perhaps ask him how he arrived at the price, since Apple doesn't sell the iPod Touch ear buds as a separate product.

I guess he felt of him and they didn't feel right according to his response. Here's the response I got back.

"thanks for the fast response, i left the way it was after i felt like the headset feels totally different. but im going to send you the headset back."

He says they feel different. I know where there's at least 3 more sets of earbuds from iPod Touch's and if
are the same as what he sends back he's getting them back, I believe he thinks he's suppose to get these:

My son still has his sealed up from his 2nd Gen. iPod Touch, were their any changes made in the earbuds
between the 2nd Gen and the 4th Gen.?

already started my reply and had not sent it yet. She gets about 1 or 2 nut cases a year like this.

From direct purchase experience,

3G earbuds had the mic/volume control
4G earbuds are plain*

* (which I found a disappointingly cheapskate move on The Leader's part, BTW. Not so much for the mic, but for the handy volume control)

Dont give him sh!t. tell him those are the real things and he can take them to an Apple store if he needs them appraised.

Send him this and then tell him not to ship them back to you.

As a more minor point of differentiation, the 32 GB and 64 GB configurations of the iPod touch 3rd Gen shipped with a pair of "Apple Earphones with Remote and Mic" and the iPod touch 4th Gen models only ship with standard earbuds (but support both).
