‘ Dominion Voting suing “kraken” lawyer Sidney Powell for $1.3B ‘

“ Dominion Voting Systems has filed a suit against former Trump campaign attorney Sidney Powell, alleging that her widespread, unfounded conspiracy theories led to both reputational damage to the company and death threats against its employees. Dominion is seeking $1.3 billion in damages.

Statements made by Powell, "in concert with allies and media outlets" presenting a "false preconceived narrative" about the 2020 election, caused "unprecedented harm" to Dominion, the company said in its suit (PDF).

Powell is the attorney who filed the "kraken" lawsuits seeking to de-certify the results of the 2020 election. The Trump campaign abruptly cut ties with Powell in late November, but that stopped neither her increasingly outrageous claims nor her increasingly ludicrous lawsuits from flowing. Not only were Powell's suits based on unfounded conspiracy theories, but they were also just plain bad filings in myriad other ways, including naming locations that didn't exist, misspelling ones that did, and naming plaintiffs who had not agreed to participate in the case. ”

Saw that earlier, looks like the only successful 2020 Election lawsuits will be from Dominion. They're not taking any crap.

But I wonder where Sidney Powell will come up with $1.3 Billion, I can't imagine that she'll ever get any more paid work.

Rudy should be next on their list, and on Jan 21st, 45 should be hearing from them.

Somebody please help me on this: is "the kraken" referring to the saurian underwater beast from a mediocre movie from years ago, as in "Release the Kraken!") ?

I kind of assumed that when she started talking in that way, but it's still weird.

And yes, they should have filed against the Trump campaign, Trump as an individual, and whoever else they know to have been involved. Legal filings usually include a statement that there are additional individuals who may be named later, as in "Does 1 - 100," and there is always some statement about "leave to amend." Maybe they think that limiting the defendants to this person will play better at trial, since it is easier to argue actual malice.

I heard Josh Barro interview the Dominion general counsel, and they are in it to win it. They fear that their sales efforts for their machines have been devastated in Red States so they can claim that the defendants have put the company in jeopardy. They have the receipts, of course, and under discovery are likely to find lots of interesting email. They did not intend to be partisan, but this is likely to be a major shitshow.

In the interview i just mentioned the counsel said they were going after everyone. I would bet Lin Wood, Rudes, and the congresscritters who participated, along with Trump.

What is key here is that the damages are real, not just claimed. And while Ken White (Barro's pod partner) guesses Dominion will be a 'public figure' which means a higher bar in the law, he felt that the claims were so egregious that Dominion has a good case.

And Dominion really does not have an incentive to settle. They would like their name cleared so a secret settlement of the sort Trump is famous for will not really work.
