At least from the hearings yesterday it looks like the initial proposal with its lack of accountability will not go through Congress unaltered. Can only hope they put in sufficient oversight and actually use it.
As for the "unelected official", besides being an insider and wanting a "free" ride on accountability, he most likely would not be around in a few months to answer for any issues of misuse. His position almost always gets a new appointee when the administration changes, even if to a candidate from the same party.
