It’s possible the seller bought the toner second-hand. Did the retaped box look like it might have been factory sealed if only given a casual glance? A seller might not want to open the box to inspect if that would mean it wasn’t sealed any more. If so, their sin was one of carelessness (not looking close enough)and not of malice. Also stupid that they’re fighting it. How much did a second-hand toner cartridge cost them that they would want to flip it on eBay? Couple bucks, max? At any rate, you should be good by eBay.

No, it incredibly obvious that the tear strip was gone and there was a gap between the two top pieces of the "lid" of the box with maybe a 3/4" gap between the two with tape connecting them....

This is a typical thing - sellers buy palettes of store returns and look them over. If the box looks new, they might list it as new without looking inside.
