It's the fear of legal costs in fighting the NDA that is the deterrent.
But that might work both ways. It would mean that 45 would have to spend his money to fight a case where he wouldn't see a dime, but the money would go to the US Treasury.
Given his views on paying taxes to the US Treasury I think it may be a difficult decision for him.
