Hmm. Looks like this is what was actually denied:

Oct 31 2008 Application (08A391) for an injunction pending disposition of the petition for a writ of certiorari, submitted to Justice Souter.
Nov 3 2008 Application (08A391) denied by Justice Souter.

Sounds to me like the application to lock Obama up until the petition is "disposed" was denied. The petition itself has not been denied. The typical legal maneuver of attempting an end run...rarely succeeds, but you always try.

There is NOTHING in the Supreme Court docket that in any way indicates that any of this is true. That the petition has not yet been denied does not mean that the case has been accepted. Obviously Souter had to make a ruling on the injunction right away since it called for immediate action. The only evidence you have to the contrary is some right-wing nutcase's blog entry. Actually, Obama's birth certificate killed Vince Foster. He was examining it for Hillary Clinton when he accidentally gave himself a really nasty papercut. As he fumbled through his medicine cabinet to get some Neosporin, he accidentally knocked his handgun off the shelf. It fell, hit the sink and discharged, shooting him at close range. Injured, he left the appartment and stumbled towards the hospital to get treatment. You know the rest of the story, of course.
