Didn't Data Rescue used to have an explicit warning that it could not recover trashed files in OSX once the trash had been emptied?

Its good that she stopped using the system further to avoid the files being over-written. I think data recovery software can recover the accidentally deleted files. You should run a demo on your system first to check the working of the software.
