This administration truly is the apocalypse for democracy. However imperfect, our form of governance is under attack from the top. My fear is a civil war will ensue, if not full blown then at least widespread terrorism and murder "overlooked" by local and federal police in many cases...as we've already seen the past several months and even years (Oregon militias seizing Federal lands, anyone?). And if not that, then outright election theft (they did it before) with much worse consequences this time than we could ever imagine.

Kudos to Putin.

I don't think the DOJ gets to alter congress's power to spend. But what do I know, I don't watch fox and friends.

The Dept of Justice makes major grants to states and cities. That's the funding they are talking about. It is not appropriated by Congress.

Where do the DOJ’s monies for funding come from?

“The process of creating the executive budget consists of three phases. The first stage is the development of the president's budget. In this stage, the president submits a comprehensive budget to the United States Congress that covers the full range of federal activities. Next, the budget proposal is edited and revised by Congress. Last, the budget is finalized and executed. It is then given a budget bill from the legislature. The legislature composes the budget bill while an executive agency implements the bill by choosing which projects to take on within the limitations imposed.”

“... funds provided in statutes are not automatically available to agencies for obligation. Appropriated funds first must be apportioned by fiscal quarter or by activity as appropriate. The Office of Management and Budget is responsible for reviewing apportionment requests and making funds available to agencies.”

They're talking about specific grants award by the agencies; not the agency's overall budget which is of course appropriated by Congress.

Courts can block Trump from doing this, and I expect/hope they will, but it's also possible Barr has found loopholes in grantmaking rules that allow the Exec Branch to enact these new rules. This is money the agencies already have and that they have the discretion to dole out through grants. Congress granted them that discretion.

Notice the very narrow language in Trump's Sept. 2 Memo that started this whole thing:

© Within 30 days of the date of this memorandum, the Director of OMB shall issue guidance to the heads of agencies on restricting eligibility of or otherwise disfavoring, to the maximum extent permitted by law, anarchist jurisdictions in the receipt of Federal grants that the agency has sufficient lawful discretion to restrict or otherwise disfavor anarchist jurisdictions from receiving.

Barr talks about sedition laws being applied to political opponents. And now this. Trump and Barr are already telling us what they will do if they are reelected. They will use the government in whatever way they can to threaten and harm political opponents. (I know they already have but they will become much, much more bold about it.) And those things would probably only be the beginning.
